EasyEDA for Education Service Agreement
JiaLiChuang (HongKong) Co., Limited ("EasyEDA" ,"we", "us", or "our") hereby remind our users ("user" or "you") to read and understand this EasyEDA for Education Service Agreement ("this Agreement").
This agreement are in addition to the EasyEDA Terms of Use and shall apply to you if you belong to a K12 public or private school ("Educational Institution") and are getting verified to use the EasyEDA Education Edition. For proper use of EasyEDA education edition and its Services, please read carefully and fully understand this Agreement herein before your apply for the EasyEDA education edition and submit your information.
In this agreement, a "Teacher" means an individual who is working for an Educational Institution and whose primary role is teaching its enrolled students; a "Child" is considered a person under the age of 13 years old (or the minimum legal age in the child’s country to be able to provide lawful consent to the processing of their personal data).
I.Acceptance of this Agreement
By clicking on the "submit" button in the application form and/or accessing or using the EasyEDA education edition and its Services, you agree to comply with and be bound by this Agreement.
II.How We Process Your Personal Data
1.In order to applying for EasyEDA Education Edition and using its features, you need to get verified as a teacher first, and we need to collect the following information from you, including: the name of your school; your name that appears on the teaching qualification certificate; your educator status proof such as school ID card, school employment status and K-12 teaching certification(which may include:Full name; School or organisation name; Date with current academic year).
2.To ensure the accuracy and security of the certification, you understand and agree that we will review the information you submit when you are certified as well as the certification materials you upload. We will strictly protect the certification information you submit, and without your consent, EasyEDA will not disclose or provide your application information to a third party.
3.Period of use of personal data
(1)We store and retain your personal data from the date we obtain it when you use the Services until you cancel your account;
(2)We will delete or anonymise your personal data after it has exceeded the necessary retention period, unless otherwise provided by law or regulation;
(3) In the event that our products or services cease to operate, we will notify you by push notification, announcement, etc. and delete or anonymise your personal data within a reasonable period of time.
III.How We Protect Your Personal Data
We will strictly protect the security of your personal data in accordance with the EasyEDA Privacy Policy .
We use a variety of security technologies and procedures to help protect your personal data from unauthorized access, use, disclosure, destruction, modification, or disruption. We will take all reasonably practicable measures to protect your personal data.
IV.Notes for Teachers' Applications
1.You understand and agree that we will exercise reasonable and prudent formality in reviewing the information you provide and the certification materials you submit, however, we are unable to substantively review your educator status and your school, within our lawful authority and reasonable ability to do so, and we do not provide any warranty in this regard.
2.You warrant that the information you provide during the teacher certification application process is lawful, valid, true, accurate and complete, and that you will not use the Service by any unlawful, illegal, improper or deceptive means.
3.If the certification materials you submit or the information you provide are inaccurate, untrue, irregular or illegal, or if we have reasonable grounds to suspect that you have fraudulently used or forged the supporting documents, We may refuse to provide you with the Service of EasyEDA education edition, and if any resulting third-party complaint or litigation claim arises, you shall deal with the matter on your own and bear all the legal liabilities that may be incurred as a result of such a complaint or litigation claim.
4.EasyEDA has the right to judge whether your behavior complies with the terms of this Agreement. If you are deemed to have violated relevant laws and regulations or fail to comply with this Agreement or related rules, based on the severity of your violation, we have the right to independently judge and, as the case may be, take measures such as restricting some or all of the features of your account until the termination of the provision of services, permanent closure of the account, etc., and We assume no liability for any loss or damage arising from your inability to use the account and related services, or the inability to normally obtain any rights and interests in your account, etc.
5.EasyEDA will erase your personal data without undue delay when it is no longer necessary in relation to the purposes for the EasyEDA service, or in legal cases such you have deleted account, withdraw consent, with the exception of the following cases:
(a)compliance with laws and regulations regarding the retention of information;
(b)reasonable extensions of deadlines are required for financial, audit, dispute resolution and other purposes
(c)for the establishment, exercise or defence of legal claims.
V.Notes for the Education Edition
1.Students can only be invited to sign up EasyEDA for Education by educational institutions or teachers. To the extent permitted by law, before inviting a student to join an EasyEDA class/group, you should ensure that you have obtained the necessary parental or other guardian's consent to use EasyEDA Education Edition for all students under 13(or the age stipulated by local laws). You can refer to the Guardians Consent Form for students' parents or other guardians to sign.
2.The educational institution, teacher or staff member who applies for EasyEDA Education Edition is the data controller of the students. Teachers and educational institutions are obliged to process and protect students' personal data such as name, email address, password, student number and class.
VI.Disclaimer
1.Due to the limited methods available to us under the current state of the art and the difficulties involved in conducting teacher identification online, we do not guarantee the accuracy and absolute authenticity of the authentication you complete;
2.We assume no liability for any failure to be certified or any other loss suffered by you as a result of any inaccuracy, untruthfulness, irregularity or illegality in the certification materials submitted or information provided by you, or if we have reason to suspect that you have fraudulently used or falsified certification materials.
VII.Updates of this Agreement
We may modify or update this Agreement from time to time to conform changes in our business and international compliance requirements. For the latest version, please visit our official website (https://easyeda.com). If you continue to access or use the EasyEDA for Education and its Services, you will be deemed as you having read and agreed to be bound by the updated Agreement. If you do not accept the updated Agreement, please stop using the Services.
